PCA CONSUMER AGREEMENT UPDATE
Effective 6/1/2026, MassHealth updated its Consumer Agreement for Personal Care Attendant (PCA) Fiscal Intermediary Services. All Consumers must review, sign, and return the updated agreement.
The Consumer Agreement explains the key responsibilities for individuals who receive PCA services through MassHealth. By signing it, Consumers confirm they are the employer of their PCAs and understand what is required to hire, manage, and approve PCA work.
It also outlines the tasks Tempus Unlimited completes as the Fiscal Intermediary, helping ensure accurate records, proper payroll processing, and compliance with MassHealth rules.

What You Need to Do:
- Review the updated Consumer Agreement
- Sign and date the agreement
- Return the completed form in order to hire a new PCA
- Submit the updated Consumer Agreement only once
Who Must Sign: Only the Consumer or the Consumer’s Legal Guardian can sign this agreement.
Important Note: Surrogates are not permitted to sign the Consumer Agreement on behalf of the Consumer.

The Consumer Agreement outlines your role and responsibilities as a Consumer and gives Tempus Unlimited Fiscal Intermediary (FI) permission to perform employer-related tasks on your behalf. The updated Consumer Agreement reflects current program and policy regulations. By signing the agreement, you acknowledge that you understand the current program requirements and responsibilities.
What happens if I do not sign and return the updated Consumer Agreement?
Failure to sign and return the updated Consumer Agreement will result in delays when hiring a new PCA.
Can a Legal Guardian sign the Consumer Agreement?
Yes, a Legal Guardian may sign the agreement on a Consumer’s behalf.
Why does it say I am the employer of my PCA? What does that mean?
The PCA Program is a self-directed program where you, the Consumer of PCA services, are the employer of your PCA. You are responsible for hiring, scheduling and managing your PCA and the services your PCA provides to you.
When do I need to return the updated Consumer Agreement to Tempus FI?
Effective 9/1/2026, the updated Consumer Agreement must be signed and returned to Tempus in order for you to hire a new PCA.
